Check And Double-Check Marina Slip Contracts

Boat owners who are set to renew their marina slip contracts this year should take a few extra
minutes to read their contracts carefully, as marinas have begun to include language that moves the
various legal liabilities away from the marina and onto the slip holder.
Phrases such as “defend and indemnify” and “hold harmless and indemnify” are red flags that the marina is protecting itself against damages that it in fact may have caused, arising from injury and damage to the boat incurred as a result of the marina’s negligence.
If this type of language is found, boat owners should contact their insurance agencies to make sure they have coverage for such contractual liabilities before signing any binding agreement.
